Terms of Service

These Terms of Service ("Terms") govern your use of VocaDeck ("the Service"), operated by Felix Martinsson ("we", "us", or "our"). By creating an account or using VocaDeck, you agree to these Terms.

1. The Service

VocaDeck is a language learning application that uses AI to generate vocabulary flashcards, reading texts, and spaced repetition scheduling. The Service is available as an iOS app and via web browsers.

2. Eligibility

You must be at least 13 years old to use VocaDeck. If you are between 13 and 18 years old, you must have parental consent. By using the Service, you represent that you meet these requirements.

3. Account

You create your account using an email address. You are responsible for keeping your email account secure, as anyone with access to it can receive a login link. You may only create one personal account. You may not transfer your account to another person.

You may delete your account at any time via Settings → Account → Delete Account. We will delete your data within 30 days.

4. Subscription and Payment

Free tier. You may review flashcards you have already created without a paid subscription.

Paid subscription. Generating new flashcards, generating reading texts, running vocabulary assessments, and unlocking more than one language require an active paid subscription.

Pricing. Current pricing is displayed in the app at the time of purchase. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Free trial. New accounts receive a free trial period as displayed in the app at the time of sign-up. Your payment method is charged when the trial ends unless you cancel beforehand.

Billing. Subscriptions are managed through Apple's App Store (iOS). You may cancel your subscription at any time through your App Store subscription settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer refunds except as required by applicable law or Apple's refund policy.

GDPR/consumer law. If you are in the EEA and you have purchased a subscription, you may have a statutory right to cancel within 14 days of purchase ("cooling-off period"). However, if you have already used the Service during this period (generated content, run assessments), you may not be entitled to a full refund.

VocaDeck generates flashcards and reading texts using AI based on your prompts. The generated content is for your personal educational use. You own the flashcard notes and custom content you write yourself.

You grant us a limited license to store and display your content as necessary to provide the Service (e.g., syncing your cards across devices).

AI-generated content (flashcard translations, example sentences, reading texts) is produced by OpenAI's API on our behalf. We do not guarantee that AI-generated content is always accurate. Language learning content should be cross-referenced with authoritative sources for high-stakes use.

7. Intellectual Property

VocaDeck's software, design, brand, and vocabulary catalog (master word lists with frequency rankings, CEFR classifications, and enrichment data) are our intellectual property. Nothing in these Terms grants you any ownership over them.

The VocaDeck name, logo, and associated marks are our trademarks. You may not use them without our prior written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

11. Termination

We may suspend or terminate your account if you violate these Terms. We will provide notice where reasonably practicable. If your account is terminated for cause, you are not entitled to a refund of any prepaid subscription fees.

You may terminate your account at any time by deleting it in Settings.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden, unless applicable consumer protection law in your jurisdiction requires otherwise. If you are an EU consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
